Reclamerecht. Uiting op website waarin o.a. staat: bij aankoop LG Blu-ray speler het Inception Blu-ray filmpakket cadeau.
Klager stelt dat de voorwaarde dat het aanbod alleen gold bij deelnemende winkels in grote letters op website vermeld had moeten worden. Klacht is gemotiveerd weersproken.
Commissie oordeelt dat niet in uiting staat vermeld dat aanbod alleen geldig is bij bepaalde verkooppunten. Deze voorwaarde blijkt alleen uit de actievoorwaarden elders op site vermeld. Sprake van verborgen houden van essentiële informatie (art. 8.3 aanhef en onder c NRC). Strijd met art. 7 NRC. Doet aanbeveling.

In de bestreden uiting staat dat men een Inception Blu-ray filmpakket cadeau krijgt bij aankoop van 1 van de LG Blu-ray spelers, zonder dat daarbij een duidelijk voorbehoud wordt gemaakt met betrekking tot het feit dat men alleen voor dit cadeau in aanmerking komt, indien men de Blu-ray speler aanschaft bij één van de deelnemende verkooppunten. Dit gegeven blijkt pas uit de elders op de bewuste site opgenomen actievoorwaarden. Aldus is er naar het oordeel van de Commissie sprake van een verborgen houden van essentiële informatie die de gemiddelde consument nodig heeft om een geïnformeerd besluit over een transactie te nemen als bedoeld in artikel 8.3 aanhef en onder c van de Nederlandse Reclame Code (NRC).

A poster advertisement featured a client of Keith Anthony Weight Loss Centres and showed a before photograph of the client also alongside the caption “I’ve lost 4 stone 3lbs in 14 weeks.” The headline stated “Strictly no bars, no sachets, no supplements, no gimmicks.” The advertisement provided a web address and further contact details for the weight loss centres.

The advertisement featured four men whispering the words of the song I love Rock ‘N Roll while driving with a baby in the back seat. They pulled up to the side of the road to drop the baby with the mother and then continued on driving while singing at the top of their voice. It appeared the men were driving to a sporting event.

The advertisement featured three plastic dolls dressed as insurance workers, and they were sitting around the canteen table talking about car insurance:

The advertisement showed various everyday life scenarios that were powered by Airtricity energy. This included imagery of a sports stadium lit up at night, a hospital ward, the luas, a couple out walking late at night under street lighting and a mother and daughter at bedtime.

An advertisement for the Car Buyers Guide featured a couple who were selling their car on the advertisers’ website. The advertisement began with the girl in hot pants and cropped top draped over a car using the automatic feature on a camera to take pictures of herself. Next she was shown uploading the photographs to the advertisers’ website and explaining to her partner that she took some photographs of his car and uploaded them to sell the car. When showing him the photographs she said “I reckon these might sell it.”

Levertijd iPhone bij T-mobile

Reclamerecht. Aanprijzing van iPhone op T-mobile website waarop o.a. staat: "levertijd van 3 tot 4 weken." Klager bestelt iPhone bij T-mobile shop nadat klantenservice heeft bevestigd dat zij ook dezelfde levertijd hebben als online. Echter, levertijd bleek meer dan 8 weken te zijn, acht uiting op website daarom misleidend. Verweerder stelt dat mededeling geen reclame in de zin van NRC. Ook geen sprake van misleiding want bestelling via webshop heeft levertijd 3 tot 4 weken en levertijd T-mobile shop wijkt daarvan af.

Commissie oordeelt dat er sprake van onduidelijke of dubbelzinnige informatie (art. 8.2 aanhef en onder b NRC) want geen onderscheid gemaakt tussen bestelling bij webshop of winkel dus mededeling te absoluut. Strijd met art. 7 NRC. Doet aanbeveling.

Grieven: 1. Commissie oordeelt ten onrechte dat er sprake is van reclame, want geen aanprijzing. 2. Ten onrechte geoordeeld dat sprake is van onduidelijke en ondubbelzinnige informatie, klant ziet voor bestelling geldende voorwaarden duidelijk genoemd. 3. Ten onrechte geoordeeld dat uiting misleidend is want als via webshop wordt besteld is sprake van genoemde levertijd.
CVB oordeelt dat uiting onder reikwijdte art. 1 NRC valt want uitnodiging tot aankoop. Grief 1 treft geen doel. Bij bestelling via webshop wordt genoemde levertijd vermeld en duidelijk dat deze niet van toepassing is op andere wijze van bestellen. Ontbreken van uitdrukkelijke mededeling hierover is niet onjuist of misleidend. Ontbreken van mededeling omtrent levertijd bij andere wijzen van bestelling is ook niet onjuist of misleidend. Grief 2 en 3 treffen doel. CVB vernietigt beslissing Commissie en wijst klacht alsnog af.

 

2. Vaststaat dat in de uiting zonder verdere toelichting uitsluitend de levertijd wordt genoemd die van toe­pas­sing is indien men het apparaat via de webshop be­stelt. Het College acht dit juist. Voor de consument die ervoor kiest om het appa­raat via de webshop te bestellen, zal duidelijk zijn dat de genoemde levertijd specifiek voor die wijze van bestellen geldt, derhalve niet van toepassing is bij een andere wijze van bestellen zoals via een winkel. Het ontbreken van een uitdrukkelijke me­dedeling hier­over kan om die reden niet onjuist of misleidend worden geacht. Even­min kan het onjuist of misleidend worden geacht dat de consument niet wordt ge­wezen op het feit dat bij een andere wijze van bestellen een langere levertijd geldt.

Het dient immers als algemeen bekend te worden verondersteld dat de duur van de levertijd per verkoopkanaal kan verschillen. De grieven 2 en 3 treffen op grond van het voorgaande doel.

Uiting over Dell verzending binnen 24 uur te absoluut

RCC 13 april 2011, Dossiernr. 2011/00026

Reclamerecht. Uiting op website waarin staat dat bestelde laptop binnen 24 uur verzonden wordt. Klager bestelde de laptop maar deze zou pas 10 dagen later bezorgd worden. Daarom heeft klager bestelling proberen te annuleren, wat niet lukte en klaagt over misleiding van de uiting. Verweerder stelt dat verzending binnen 24 uur aan voorwaarden onderhevig is die op website vermeld staan. Per ongeluk is na annulering bestelling, deze opnieuw ingevoerd en toch bezorgd. Geen sprake van misleiding. Repliek: in uiting wordt geen voorbehoud gemaakt. Dupliek: voorwaarden zijn over het algemeen eenvoudig te raadplegen.

Voorzitter oordeelt dat er sprake is van onjuiste informatie (art. 8.2 aanhef onder b NRC), want niet weersproken dat bestelling niet binnen 24 uur is verzonden en geen voorbehoud gemaakt in uiting. Strijd met art. 7 NRC. Bezwaar tegen beslissing voorzitter: adverteerder stelt dat er wel verwezen wordt naar voorwaarden en klager dit ook erkent.

Commissie: uiting is te absoluut nu voorbehoud of verwijzing naar voorwaarden ontbreekt. Bevestigt beslissing voorzitter en doet aanbeveling.

 

Het oordeel van de Commissie

De bij de laptop van het model Inspiron 15 geplaatste mededeling “Verzending binnen 24 uur!” wekt de indruk dat deze laptop binnen 24 uur na bestelling wordt toegezonden. Dit aspect kan doorslaggevend zijn voor de beslissing deze laptop aan te schaffen, zoals ook bij klager het geval was. In de uiting is bij de mededeling “Verzending binnen 24 uur!” geen voorbehoud gemaakt of verwijzing naar van toepassing zijnde voorwaarden opgenomen, hoewel vast is komen te staan dat slechts onder bepaalde omstandigheden verzending binnen 24 uur na orderbevestiging mogelijk is. Naar het oordeel van de Commissie zijn deze elders op de website van adverteerder vermelde (beperkende) voorwaarden zo essentieel, dat de bestreden uiting door het ontbreken van een voorbehoud of verwijzing naar deze voorwaarden te absoluut is.

Gelet op het vorenstaande gaat de bestreden uiting gepaard met onjuiste informatie over een van de voornaamste kenmerken van het aangeboden product als bedoeld onder b van artikel 8.2 NRC, te weten de levering. Voorts is de Commissie van oordeel dat de uiting de gemiddelde consument ertoe kan brengen een besluit over een transactie, te weten de aankoop van de Inspiron 15 laptop, te nemen dat hij anders niet had genomen. Om die reden acht de Commissie, overeenkomstig de beslissing van de voorzitter, de uiting misleidend en daardoor oneerlijk in de zin van artikel 7 NRC.

Adapter retour onmogelijk zonder contact

Voorzitter RCC 7 april 2011, Dossiernr. 2011/00172 (adapter retour)

Reclamerecht. Uiting op www.adaptercentrum.nl over "niet goed, geld terug"-garantie. Klager stelt geen contact te hebben kunnen krijgen met adverteerder om accu te retourneren. Klaagt ook over logo thuiswinkelkeurmerk op de website. Verweerder stelt aan klager te hebben laten weten dat accu geretourneerd kon worden. Nu klager deze onderhands heeft verkocht, kan verweerder niets meer voor hem doen aldus verweerder.

Voorzitter acht dat Commissie klacht zal toewijzen en baseert zich op het volgende: nu klager geen contact kon krijgen met adverteerder en dit niet door verweerder is weersproken, is niet voldaan aan eis van art. 15c lid 1 aanhef en onder b BW. Hierdoor handelt adverteerder in strijd met art. 2 NRC. Voorzitter kan niet oordelen over logo thuiswinkelkeurmerk op website nu klager hier geen bewijs van heeft overlegd en laat het derhalve buiten beschouwing. Voorzitter doet aanbeveling.

1)  De voorzitter is van oordeel dat de Commissie de klacht zal toewijzen. Hij overweegt daartoe het volgende.
2)  In de reclame-uiting staat als voorwaarde voor het terugstorten van het aankoopbedrag dat het product dient te worden retour gezonden, waarna binnen vijf dagen het aankoopbe­drag wordt teruggestort. Klager, die een niet-passende accu bij adverteerder heeft gekocht, heeft in verband hiermee diverse malen tevergeefs contact gezocht met adverteerder. Nu klager on­weersproken heeft gesteld dat hij, ondanks diverse pogingen, geen con­tact kon krijgen met adverteerder, is niet voldaan aan de eis van artikel 15c  lid 1 aanhef en onder b BW, dat adverteerder - kort gezegd - gege­vens dient te noemen die op gemakkelijke en directe wijze een snel contact en rechtstreekse en effectieve communicatie met hem moge­lijk ma­ken. Als gevolg hiervan heeft geen com­mu­nicatie kun­nen plaatsvinden tussen klager en ad­verteerder over de terugzending als bedoeld in de gewraakte uiting. Al­dus heeft adver­teer­der niet vol­daan aan een wettelijke verplichting die zich ook uitstrekt tot de reclame-uiting, en heeft adverteerder daardoor gehandeld in strijd met artikel 2 van de Ne­derlandse Recla­me Code (NRC).
