Colofon is reclame

Reclamerecht. In het colofon van De Telegraaf, onder het kopje ‘BEZORGINFORMATIE’:
“De krant wordt voor 07:00 uur bezorgd (…)”
 
De klager meldt dat de krant op zaterdag pas om 7:30 wordt bezorgd. Adverteerder stelt dat het colofon van het dagblad geen reclame-uiting is in de zin van artikel 1 van de Nederlandse Reclame Code (NRC), subsidiair is het niet misleidend ex art. 8 NRC omdat de klager niet aannemlijk heeft gemaakt dat hij, althans de gemiddelde consument, géén abonnement zou hebben genomen, indien hij had geweten dat de krant op zaterdag om 7.30 uur wordt bezorgd. Daarbij is, conform de leveringsvoorwaarde sprake van een inspanningsverplichting.

In de eerste plaats is de Commissie van oordeel dat de bewuste mededeling in het colofon moet worden aangemerkt als reclame in de zin van artikel 1 NRC. Nu het een colofon in een dagblad betreft, staat vast dat de uiting openbaar is. Voorts gaat er onmiskenbaar een aanprijzende werking uit van de mededeling. Het zal veel mensen, zoals ook klager, aanspreken dat de krant ’s ochtends voor 7.00 uur wordt bezorgd.
 
Naar is komen vast te staan wordt (in ieder geval) in Hoevelaken de krant op zaterdag pas bezorgd om 7.30 uur. De mededeling ‘De krant wordt voor 07:00 uur bezorgd’ acht de Commissie derhalve te absoluut.
De Commissie is van oordeel dat de reclame aldus gepaard gaat met onjuiste informatie met betrekking tot één van de voornaamste kenmerken van het product als bedoeld in artikel 8.2 sub b, te weten het tijdstip dat de krant wordt bezorgd. De Commissie is voorts van oordeel dat hierdoor de gemiddelde consument ertoe gebracht kan worden om een besluit te nemen over een transactie, dat hij anders niet had genomen. Het tijdstip waarop een krant wordt bezorgd kan immers van wezenlijk belang zijn bij de keuze van een abonnement. Om die reden is de uiting misleidend en daardoor oneerlijk als bedoeld in artikel 7 NRC.

De beslissing
 
De reclame-uiting is in strijd met artikel 7 van de Nederlandse Reclame Code. De Commissie beveelt adverteerder aan om niet meer op een dergelijke wijze reclame te maken.

Is Grolsch Stender nieuw?

Reclamerecht. Bierviltje met de tekst "Nieuw Grolsch Stender 100% bier, 0,5% alcohol." Klager stelt dat Grolsch Stender al in 1992 bestond en er dus geen sprake is van een nieuwe biersoort. Verweerder stelt dat het in de jaren negentig verkochte bier Stender en het huidige Stender twee compleet van elkaar losstaande producten zijn. Belangrijkste verschil is receptuur, smaak en uitstraling. Daarom sprake van nieuw bier.
Commissie oordeelt dat verweerder voldoende aannemelijk heeft gemaakt dat er verschillen zijn tussen beide producten. Niet onjuist om het huidige Stender daarom aan te prijzen als "nieuw". Klacht wordt afgewezen.

Het verweer
De merknaam Stender van het in maart 2011 geïntroduceerde alcoholarme Grolsch Stender komt overeen met het bier dat door Grolsch in de jaren 1990-1993 is verkocht. Dit is echter de enige overeenkomst, voor het overige zijn het Stender uit de jaren ‘90 en het nu geïntroduceerde Grolsch Stender twee compleet van elkaar losstaande producten. Het belangrijkste verschil betreft de receptuur en de smaak. Bij het brouwen van Grolsch Stender wordt een nieuwe gistsoort gebruikt die op natuurlijke wijze de productie van alcohol tijdens de gisting stopt. Bovendien was het Stender uit de jaren ’90 een stand-alone merk met een van Grolsch losstaande uitstraling, terwijl Grolsch Stender in de groene Grolsch fles zit.

Grolsch communiceert derhalve terecht dat sprake van een nieuw bier.

"Dan zitten ze eraan vast"

RCC 14 juli 2011, Dossiernr. 2011/00408 (Sunweb)

Reclamerecht. Radio- en televisiecommercial van Sunweb waarin o.a. wordt gezegd: "Snel boeken! Dan zitten ze eraan vast." Klager stelt dat deze tekst niet klopt, want als de prijs enigszins anders en in het nadeel van Sunweb wordt de boeking geannuleerd. Verweerder stelt dat als klant reis boekt, deze boeking als definitieve reservering wordt beschouwd. Aanbod kan inderdaad herroepen worden wegens correctie van fouten. Prijscorrectie kan binnen acht uur na boeking worden toegepast op grond van ANVR Reisvoorwaarden, hoewel dit uitzonderlijk is. Uiting voldoet aan alle wet- en regelgeving.

Commissie oordeelt dat uitingen indruk wekken dat verweerder zich altijd gebonden acht aan boeking. Vast is komen te staan dat na de boeking een prijscorrectie kan worden doorgevoerd door verweerder. Mededeling dat verweerder aan de boeking "vast zit" is daarom te absoluut. en wekt onjuiste indruk. Sprake van onjuiste informatie (art. 8.2 aanhef NRC). Strijd met art. 7 NRC. Doet aanbeveling.

Als erkend is echter komen vast te staan dat er ver­schil­lende redenen kunnen zijn die adverteerder aanleiding geven het aanbod na de boeking te herroepen, óók voor zover het de prijs betreft. Adverteerder houdt zich im­mers het recht voor een prijscorrectie toe te passen. De mededeling dat adverteer­der ook bij zeer lage prijzen na boeking aan de aangeboden vakantie “vastzit”, is der­halve te absoluut en wekt daardoor een onjuiste indruk.

Het GVR/Slagzinnenregister introduceert een goedkeuringssymbool voor toegelaten slagzinnen. Het Predicaat Goedgekeurd is een initiatief van de nieuwe GVR/Slagzinnencommissie. Met Adformatie is tevens de publicatie van goedgekeurde slagzinnen overeengekomen.

Daarnaast vindt de commissie de tijd rijp om het slagzinnenregister zelf van een slogan te voorzien:

De nieuwe GVR/Slagzinnencommissie is samengesteld uit leden met uiteenlopende functies binnen het communicatievak. De commissie wordt voorgezeten door Lisette Heemskerk (directeur Mood for Magazines) en bestaat daarnaast uit Bas Kist (partner Chiever), Lennard Franken (account director DDB), Ramon Stalenhoef (partner SSSS & Orchestra) en Kim Braber (advocaat Hoogenraad & Haak advocaten).

Het GVR/Slagzinnenregister is in 1928 in het leven geroepen om (aanvullende) juridische zekerheden te bieden bij het claimen van slagzinnen. Registratie kan als bewijs dienen in een eventuele inbreukprocedure. De rechter hecht aan de registratie ook waarde. Bovendien wordt de slagzin bij registratie onderzocht op eventuele gelijkenis met reeds geregistreerde slagzinnen en werkt registratie preventief tegen mogelijke navolging.

Alleen slagzinnen die volgens het reglement voldoende origineel en onderscheidend zijn worden in het register opgenomen. Recent door de GVR/Slagzinnencommissie goedgekeurde slagzinnen zijn bijvoorbeeld:

Reclamerecht. Televisiecommercial over discomuntjes waar muziek op staat. Klager stelt dat uiting misleidend is omdat de muntjes geen volledige liedjes afspelen maar slechts 15 seconden van het nummer. Verweerder stelt dat wegens auteursrechtelijke redenen de nummers maar 20 seconden lang zijn. Uiting suggereert niet dat liedjes volledig op muntjes staan.
Commissie oordeelt dat uiting gedeeltelijk gericht is tot kinderen. KJC is daarom van toepassing. Indruk wordt gewekt dat gehele liedjes op muntjes staan dus misleidend voor kinderen. Strijd met art. 1 KJC. Ook voor andere personen onduidelijk t.a.v. voornaamste kenmerken product (art. 8.2 aanhef en onder b NRC). Strijd met art. 7 NRC. Doet aanbeveling.

Naar het oordeel van de Commissie wordt door de mededeling dat je de met name genoemde artiesten “gratis op deze disco’s” krijgt, de indruk gewekt dat complete liedjes op de disco’s staan. Kinderen hoeven er niet op bedacht te zijn dat de disco’s slechts zeer korte fragmenten van liedjes bevatten, nu daaromtrent in de commercial geen enkele mededeling wordt gedaan. De Commissie acht de commercial misleidend voor kinderen en om die reden in strijd met artikel 1 KJC.

De volgende dag bezorgd

RCC 6 mei 2011, Dossiernr. 2011/00302 (TNT Post)

Reclamerecht. Televisiecommercial van TNT Post met o.a. de tekst: "de volgende dag bezorgd". Klaagster stelt dat bij haar de post regelmatig pas na twee tot vier dagen wordt bezorgd, ondanks juiste adressering. Verweerder stelt dat in 95% tot 98% van de gevallen de post de volgende dag bezorgd wordt. Uiting houdt geen garantie in van 100% tijdige bezorging. Zal voortaan disclaimer in uiting opnemen.
Commissie oordeelt dat 2% tot 5% van de gevallen post niet binnen 24 uur wordt bezorgd. Daarom strijd met art. 2 NRC. Doet aanbeveling.

In de commercial wordt reclame gemaakt voor de postbezorging door TNT Post “binnen 24 uur” en “de volgende dag”. Deze service wordt onderstreept door de tekst “De volgende dag bezorgd”. Adverteerder heeft meegedeeld dat in 95% respectievelijk 98% van de gevallen post daadwerkelijk de volgende dag wordt bezorgd. Dit betekent derhalve dat in 2 tot 5% van de gevallen de post niet binnen de beloofde 24 uur wordt bezorgd. Gelet hierop is de boodschap dat post de volgende dag wordt bezorgd onjuist en om die reden in strijd met de waarheid als bedoeld in artikel 2 van de Nederlandse Reclame Code (NRC).

A magazine ad for organic farming that featured a man and his son dressed in a pantomime cow costume was headlined "We love organic because we care about animals". Text beneath quoted the man featured in the ad and said "I like to see myself as the brains of this outfit, even if my son doesn't agree! But when he told me about organic, well, I never looked back. Organic means fewer drugs or antibiotics, it also means better conditions for animals so they get to thrive and grow more naturally....

Moneysupermarket.com Ltd
Website and email for a financial products comparison service: a. The website included the text "“EXCLUSIVE CREDIT CARDS...Because we’re Britain’s No. 1 comparison site we have been able to negotiate great exclusive deals especially for moneysupermarket.com customers. Use our free, independent comparison to find the best offers you can’t find elsewhere.” On the page for all UK credit cards, the “Smart Search” feature was offered as an “Exclusive service” and stated “Get approved first time....

Lawrence of Kemnay Ltd
A regional press ad, for a car dealership, appeared on 3 March 2011. It was headlined “CUSTOMER SAVING £3400” and included an image of a car. Further text stated “new model fordfiesta edge 1.25 (60PS) 3-dr New on the road price £12,395 Our on the road price £8,995 HURRY - limited number available for immediate delivery on ‘11’ reg ... ”.

Stammering Cure
A website, on 5 April 2011, with the url www.stammeringcure.org. Text stated "... Discover how to stop stuttering with stammering cure that works ... You can Click Here Now to check out one thing that really helped me with my stammer ...". A number of hyperlinks on the website led to www.killyourstutter.com, a site which advertised a product that claimed to cure a stutter.

Webfusion Ltd
A website for domain names gave prices for various types of domain names including ".co.uk £2.99 a year". Text at the bottom of the home page stated "All prices Ex. VAT".

Virgin Media Ltd
a. A national press ad for Virgin Media seen in September and October 2010 stated "Fibre optic broadband £15 a month - It's official, Ofcom have proven our fibre optic broadband is around twice as fast as BT, Sky and Talk Talk's comparable packages, even at peak times†". The cross sign was linked to footnote text which stated "Source: Ofcom, July 2010. Virgin Media up to 10Mb broadband compared to competitors 8Mb or 10Mb broadband". b. A marketer's own website, accessed on 16 April, stated "The best things in life are free ... like FREE SHIPPING! In addition to our recent storewide price reduction, we are now offering worldwide free shipping for all items and on all orders! No minimum purchase requirements!"

A sales promotion, on the kgb website, viewed on 28 March 2011. Text stated “£26 for a two-month supply of Acai Anti-Wrinkle Capsules worth £99.98 from i want to pay less - save 74%"

A promotional e-mail and a website for an airline promotion offering discounts on flights: a. The email ad stated "Gotta fly, baby! Up to 40% off ALL flights!" b. The website also stated "Up to 40% off ALL flights!". Terms and conditions at the bottom of the next page, after clicking on the promotion, stated "Offers available until Tuesday 22nd March. Up to 40% off applies to the airfare only and excludes airport taxes and charges".

Alegiance Services Ltd
An ad for a diet programme on the website www.dailyhealthalerts.com stated “Acai berries are the latest weight loss fad ... While there are ton’s [sic] of Acai berry ads online, Acai Diet Plus is one of the most credible and trustworthy suppliers on the market. It included the free* trial of the product and it did not try to fool me into agreeing to additional hidden offers”. Claims on Three's website, viewed on 27 March 2011, stated "No other network gives you more for £10. See the table below to find out how we compare to these other high-street operators". The table compared Three's package to those of Orange, T-Mobile, Tesco, Virgin, Asda, Vodafone and O2.

Midland Van Conversions
Claims on a website for a van conversion company, in April 2011, stated "Based in the heart of England, Midland van conversions have over 40 years experience within the motortrade and specialise in the conversions of all makes of panel van". The 'Gallery' section of the website featured photos of different van conversions.

National Guild of Removers Storers
Text on the National Guild of Removers & Storers website stated "No other organisation or firm comes close to matching The Guild and its Members when it comes to consumer protection measures".

MyCityDeal Ltd
Two e-mails for Groupon deal of the day coupons: a. One e-mail, sent on 15 February, stated "£98 for £1650 towards Invisalign Teeth-Bracing Technology and Whitening at Q Clinic. View now For £98,00 [sic] Discount 94% Saving £1552,00 [sic]". Carlsberg UK Ltd
A prize promotion, on packs of Carlsberg, in January 2011, stated “Main Competition 2. There are 14 main prizes to be won in total. One prize will be won every week for the duration of the promotion. Ongeoorloofde sponsoring jazzfestival
De hoofdsponsor van het jazzfestival A Jazz Weekend is in 2007 en 2009 juridisch op de vingers getikt door zowel de Rechtbank12 als het College van beroep voor het bedrijfsleven13 vanwege overtreding van de tabakswetgeving. De hoofdsponsor had in strijd met de regels rondom sponsoring van muziekevenementen op niet toelaatbare wijze de sponsoring onder de aandacht van het publiek gebracht, onder meer via de website jazz.nl. Geoordeeld werd dat de naam van het muziekevenement (en/of dat van de hoofdsponsor) een associatie met het betreffende tabaksproduct opriep. Zo maakte de naam van een bekend sigarettenmerk in beduidende mate deel uit van de naam van het evenement en was het font sterk gelijkend op dat van het sigarettenmerk. De sponsor was in 2002 in dit verband al eens eerder door de Keuringsdienst van Waren gewaarschuwd voor overtreding van de tabakswetgeving.

Jaarevaluatie Postbus 51-campagnes 2010

 

Bijlage bij Kamerstukken II 2010/11, 32 500-III, nr. 12.

De Jaarevaluatie levert feiten en inzichten over de overheidscampagnes die in 2010 via Postbus 51 zijn gevoerd.

De volgende aspecten komen daarbij aan de orde:
- De beleids- en communicatiedoelstellingen van de campagnes;
- De media-inzet en de bestedingen die daarmee gemoeid zijn;
- De communicatieve werking van de campagnes en de gerealiseerde effecten.

Communicatie via Postbus 51-campagnes is een beleidsinstrument net zoals subsidies, regelgeving en handhaving. Postbus 51-campagnes beogen, in samenhang met andere beleidsinstrumenten, een bijdrage te leveren aan het realiseren van beleidsdoelstellingen door burgers te informeren, een bepaald bewustzijn of draagvlak voor beleid te creëren en het stimuleren van gewenst gedrag.

De Jaarevaluatie biedt inzichten in de effecten van massamediale communicatie. Of campagnes er in slagen om een goede bijdrage te leveren aan de beleidsuitvoering kan alleen in de specifieke beleidscontext beoordeeld worden. In de verslagen van de afzonderlijke campagnes (zie hoofdstuk 6) staan de beleids- en communicatiedoelstellingen en de belangrijkste resultaten per campagne samengevat.

Dit hoofdstuk biedt een overzicht van de belangrijkste algemene bevindingen waarbij de campagneresultaten van 2010 op hoofdlijnen vergeleken worden met die van voorgaande jaren.
