VVD Limburg respecteert nee/ja-sticker niet

Reclamerecht. Klager stelt VVD Limburg Verkiezingskrant te hebben ontvangen terwijl hij een nee/ja-sticker heeft. Verweerder stelt dat folder per ongeluk bij klager is bezorgd.
Voorzitter oordeelt dat onweersproken is gesteld dat folder in brievenbus van klager is gedeponeerd. Verweerder heeft daarmee art. 3.1 Code VOR overtreden. Doet aanbeveling.

Klager heeft onweersproken gesteld dat de bestreden folder is gedeponeerd in klagers brievenbus, die was voorzien van een NEE/JA sticker in de zin van de Code Verspreiding Ongeadresseerd Reclamedrukwerk (Code VOR), bedoeld om kenbaar te maken dat men geen ongeadresseerd reclamedrukwerk wenst te ontvangen. Nu desondanks de bewuste folder in klagers brievenbus is gedeponeerd, heeft adverteerder artikel 3.1 van de Code VOR overtreden.

Claims on a website, for health services, appeared in March 2011. Text on the home page stated “SSP Health operate 17 NHS practices around the North West. From Manchester to Liverpool, St Helens to Chorley, we cover a wide area and look after more than 50,000 patients”. A drop down list on the home page included “Greenland Avenue, Bolton”. Greenland Avenue was listed on the “Practices” page and was linked to a full page for Greenland Avenue.

BoilerJuice Ltd
An e-mail, for a heating oil comparison website, stated "The Buying Weekend Has Started!!! If you have been waiting for the price of oil to drop before you order, now is looking like a great time to place your order!" At the bottom of the e-mail, further text stated "BoilerJuice offers a completely impartial service to both our customers and participating suppliers".

Bodum (UK) Ltd
A magazine ad, for Bodum coffee makers, showed a pile of empty coffee cartridges on the left. Text above stated "make taste, not waste". On the right, three Bodum "French press" coffee pots were depicted. Text across them stated “get green”. Smaller text stated, “The BODUM simple brewing method does not contaminate and pollute trash. Verwijdering reclame-uiting

Raad van State 29 juni 2011, LJN BQ9649 (Energiedirect tegen college B&W Utrecht)

Bij schrijven van 15 mei 2009 heeft het college Energiedirect medegedeeld dat het op 14 mei 2009 de door het bureau Jack Liberties namens haar aangebrachte reclame-uitingen en objecten bij wijze van bestuursdwang direct heeft verwijderd. Voorts heeft het haar daarbij medegedeeld dat het de kosten van het afvoeren en doen afvoeren en/of opslaan en doen opslaan van de reclame-uitingen en objecten op haar zal verhalen.

2.3. Energiedirect betoogt dat de rechtbank heeft miskend dat de situatie niet zo spoedeisend was, dat het college haar geen termijn om zienswijzen naar voren te brengen hoefde te gunnen en geen begunstigingstermijn hoefde te stellen. Zij voert daartoe aan dat het college op de hoogte was van haar identiteit, omdat op alle uitingen haar naam met vermelding van de website en het telefoonnummer stond. Indien het haar zijn voornemen kenbaar zou hebben gemaakt, zou zij direct tot verwijdering van eventueel illegaal geplaatste reclameborden zijn overgegaan. Voorts heeft het zijn oordeel dat de situatie spoedeisend was niet toereikend gemotiveerd. Een zodanig spoedeisende situatie deed zich niet voor, aldus Energiedirect.

2.3.1. Het betoog slaagt. Het college zag zich in de ochtend van 14 mei 2009 geconfronteerd met een gecoördineerde agressieve reclameactie. De rechtbank heeft echter ten onrechte overwogen dat het college zich op het standpunt mocht stellen dat de vereiste spoed zich er tegen verzette het besluit tot toepassing van bestuursdwang tevoren op schrift te stellen en Energiedirect gelegenheid te bieden om de reclameborden zelf te verwijderen. Daarbij wordt in aanmerking genomen dat met de van de borden gemaakte foto's, noch anderszins, aannemelijk is gemaakt dat de situatie in de binnenstad van Utrecht zo gevaarzettend was, dat op alle locaties onmiddellijk optreden geboden was. Dat het college, als gesteld, frames heeft geplaatst op veilige plaatsen, betekent niet dat borden op andere plaatsen daarom steeds onveilig zijn. Dat het college bij het aanbrengen van uitingen buiten deze frames direct pleegt te handhaven, biedt evenmin een aanknopingspunt voor het aannemen van de gestelde spoed. Geconfronteerd met deze actie kon en mocht het college in een besluit tot toepassing van bestuursdwang een - uiterst korte - begunstigingstermijn stellen, waarbinnen Energiedirect de tenuitvoerlegging van het besluit had kunnen voorkomen door zelf onmiddellijk maatregelen te treffen en daartoe contact met haar te zoeken. Niet is gebleken dat het college een poging heeft ondernomen om in contact te komen met Energiedirect. De gestelde door het college bij de directeur van reclamebureau Jack Liberties ten aanzien van het ongedaan maken van de actie en het bekendmaken van de opdrachtgever ondervonden weerstand, de hoeveelheid meldingen, noch het belang gelegen in de verkeersveiligheid, vormden voldoende reden om daarvan af te zien. Het college was op de hoogte van de identiteit van Energiedirect, omdat op alle uitingen haar naam met vermelding van de website en het telefoonnummer stond.

Het oordeel dat het college zich ten onrechte op het standpunt heeft gesteld dat de vereiste spoed zich er tegen verzette het besluit tot toepassing van bestuursdwang tevoren op schrift te stellen en Energiedirect een termijn te gunnen om de reclameborden zelf te verwijderen, brengt mee dat het college de kosten van de toepassing van die bestuursdwang niet op Energiedirect heeft mogen verhalen. De overige beroepsgronden behoeven geen bespreking.

Onvoldoende als reclame herkenbaar

RCC 17 mei 2011, Dossiernr. 2011/00321 (Nationale Postcode Loterij)

Reclamerecht. Een aan klager geadresseerde mailing met op voorzijde envelop de tekst "betreft uw reservering" en op achterzijde "indien onbestelbaar retourneren naar Nationale Postcode Loterij." Klager acht onduidelijk wie afzender is want onduidelijk lettertype, dus strijd met art. 2 CBR en uiting niet duidelijk als reclame herkenbaar dus strijd met art. 11.1 NRC. Verweerder stelt dat envelop wel leesbaar is en dat het haar vrij staat reclame op pakkende wijze te presenteren. Envelop duidelijk herkenbaar als reclame.
Commissie oordeelt dat door de tekst "betreft uw reservering" niet voldoende duidelijk is dat het gaat om reclame. Strijd met art. 11.1 NRC. Dat op de achterzijde de afzender wordt vermeld, leidt niet tot ander oordeel. Geen strijd met art. 2 CBR want op achterkant envelop gemakkelijk herkenbare vermelding van naam en adres adverteerder. Doet aanbeveling.

Van de tekst: “BETREFT UW RESERVERING” in combinatie met de door het venster zichtbare naam en het adres van de geadresseerde gaat voor de gemiddelde consument de suggestie uit dat de envelop informatie bevat over een door hem of haar gedane reservering. Niet duidelijk, althans niet voldoende duidelijk is dat het -naar tussen partijen vast staat- gaat om reclame van NPL.

RB 1012

Omgeboekte reis duurder

Vz. RCC 16 mei 2011. Dossiernr. 2011/00286

Reclamerecht. Uiting in brochure over reis naar Thailand vanaf 1399 euro. Klaagster stelt dat op verzoek van adverteerder reis werd omgeboekt en dat deze daardoor 400 euro p.p. duurder was geworden. Vond waarschuwing nodig, nu annulering niet meer mogelijk was. Verweerder heeft verweer gevoerd.
Voorzitter oordeelt dat Commissie klacht zal afwijzen. Uiting is niet in strijd met NRC, ook al is omgeboekte reis duurder. In uiting wordt nl. vanaf-prijs genoemd en verwezen naar website. Wijst klacht af.

Dat bij het wijzigen van de boeking voor de nieuwe reis een hogere prijs gold, brengt niet mee dat de reclame-uiting in strijd is met de Nederlandse Reclame Code. In de brochure staat duidelijk dat sprake is van een vanaf-prijs en wordt verwezen naar de website, waarop, naar door adverteerder is gesteld, de op dat moment geldende prijs wordt vermeld. Gelet op het voorgaande kan de klacht naar het oordeel van de voorzitter niet slagen.

Reclamerecht. Brochure IZA-vergoedingen 2010 en vergoedingenoverzicht op website. Klager stelt dat plaatsing kroon maar gedeeltelijk vergoed werd terwijl in beide uitingen staat dat het maximaal vergoed zou worden. Verweer is gemotiveerd weersproken.
Commissie oordeelt dat uiting onvoldoende duidelijk is voor gemiddelde consument. Uit de woorden "max. vergoeding" kan maximale vergoeding worden afgeleid. Sprake van onduidelijke informatie (art. 8.2 aanhef en onder b NRC). Strijd met art. 7 NRC. Doet aanbeveling.

De Commissie is van oordeel dat de uiting op dit punt voor de gemiddelde consument onvoldoende duidelijk is. Uit de woorden ‘max. vergoeding’ kan naar haar oordeel gemakkelijk de indruk ontstaan dat sprake is van een volledige vergoeding van de desbetreffende behandeling, temeer daar bij verschillende andere in de overzichten genoemde vergoedingen een duidelijk limiet wordt genoemd aan de te vergoeden bedragen. De afkorting “max.” kan in de gegeven context gemakkelijk tot onduidelijkheid leiden. Gelet op het voorgaande gaat de reclame naar het oordeel van de Commissie gepaard met onduidelijke informatie ten aanzien van de voornaamste kenmerken van het product zoals bedoeld in artikel 8.2 aanhef en onder b van de Nederlandse Reclame Code (NRC).

Reclamerecht. Huis-aan-huis folder met aanbieding van Lady Chrissy Sjaal voor 14,95 euro (ledenprijs). Klager stelt dat in uiting niet blijkt dat de afgebeelde sjaal bestaat uit 2 sjaals die samen 29,90 euro kosten. Verweerder is van mening dat klacht niet geheel ongegrond is.
Voorzitter oordeelt dat Commissie klacht zal toewijzen. Uiting kan indruk wekken dat men afgebeelde sjaal kan kopen voor 14,95 euro. In werkelijkheid zijn er twee sjaals afgebeeld met een totaalprijs van 29,90 euro. Sprake van ontbreken van essentiële informatie (art. 8.3 aanhef en onder c NRC). Strijd met art. 7 NRC. Doet aanbeveling.

De voorzitter is van oordeel dat de Commissie de klacht zal toewijzen. Hij overweegt daartoe het volgende.

Vaststaat dat de gewraakte reclame-uiting de indruk kan wekken dat men de afgebeelde sjaal als zodanig kan kopen voor € 14,95 (ledenprijs). In werkelijkheid blijkt de afgebeelde sjaal uit twee losse sjaals te bestaan die men elk afzonderlijk dient te kopen voor de ge­noem­de prijs. Door het ontbreken van informatie hierover zal de gemiddelde con­sument er niet op bedacht zijn dat hij in totaal € 29,90 (ledenprijs) dient te betalen voor de afgebeelde combinatie. Het gaat naar het oordeel van de voor­zit­ter om essen­tiële infor­ma­tie die de con­sument nodig heeft om een geïnformeerd be­sluit over de transactie te ne­men. Dergelijke informatie dient tijdig, dat wil zeggen reeds in de reclame-uiting, te wor­den vermeld.

Beschikbaarheid voor risico adverteerder

Reclamerecht. Folder van adverteerder waarin de Sony Ericsson Yendo Prepaid wordt aangeboden. Klaagster stelt dat haar verschillende keren is medegedeeld dat telefoon niet Prepaid te koop is. Acht uiting daarom misleidend. Klacht is gemotiveerd weersproken.
Commissie oordeelt dat er sprake is van onjuiste informatie t.a.v. de beschikbaarheid (art. 8.2 onder b NRC) nu telefoon niet in winkels van adverteerder verkocht wordt. Door adverteerder aangevoerde omstandigheden leiden niet tot ander oordeel, want deze komen voor risico van adverteerder. Strijd met art. 7 NRC. Doet aanbeveling.

Naar door adverteerder is erkend, werd de bewuste, in de folder aangeboden telefoon niet verkocht in de winkels van adverteerder.

Naar het oordeel van de Commissie gaat de reclame-uiting aldus gepaard met onjuiste informatie ten aanzien van één van de voornaamste kenmerken van het product als bedoeld onder b van artikel 8.2 NRC, te weten de beschikbaarheid.
